Terms of Use

The agreement

These terms are an agreement between you and Omni Media And Tech LLC Company, Kingdom of Saudi Arabia (“we”), for the Moticap website, apps, editor extensions and servers (“Moticap”). By using Moticap you accept them. If you use Moticap for an organisation, you accept them for it. Our Privacy Policy explains how we handle your data.

Your account

Some features need an account (sign in with an email code, Apple or Google). Keep access to your email and devices secure, and give accurate information. Each plan allows a number of devices. You must be at least 13 years old, or the minimum age in your country, to use Moticap.

Your content is yours

You keep all rights to the videos, audio, scripts, logos and other content you use with Moticap (“your content”), and to the videos you make with it. You give us only the permission needed to process your content to provide the service — to transcribe it, make looks, and render and deliver your files — for the time described in the Privacy Policy. We do not use your content for advertising, and we do not claim it.

You are responsible for your content: you must have the rights to use it, including the voices, faces, music and marks in it.

Music you add to a video yourself (from your files or your music library) is your own choice and your responsibility: use music you have the rights to use for the place you publish.

Acceptable use

Don’t use Moticap to:

• break the law or infringe anyone’s rights, including copyright, privacy and publicity;
• make content that is unlawful, defamatory, harassing, hateful, or that exploits or harms children;
• deceive people by impersonating someone or presenting fabricated speech as real;
• interfere with, overload, probe or reverse engineer the service, or get around its limits or security;
• resell or share access to an account, or access the service by automated means except through our apps.

We may suspend or close an account that breaks these rules.

The licence to the apps

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Moticap apps and extensions on devices you own or control, under these terms and the rules of the store you got them from. Moticap, its name, logo, software, looks and website belong to us or our licensors; except for this licence, no rights are transferred to you.

When you download the app from the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies, and Apple is not responsible for the app or its support.

Plans and subscriptions

Moticap may offer a free plan with monthly limits and paid plans. Plans, prices and limits are shown in the app before you subscribe and may change; a price change applies from your next billing period after notice. Subscriptions bought in the app are billed and renewed by the App Store or Google Play under their terms; manage or cancel them in your store account settings. Refunds follow the store’s policies. No plan adds a watermark to your videos.

AI-made results

Transcripts, translations, offer titles and caption looks are produced automatically and can contain mistakes. Review them before you publish; you are responsible for what you publish.

Third-party software

The extensions work inside After Effects, Premiere Pro, DaVinci Resolve and Final Cut Pro, which are products of their owners and have their own terms. Moticap is independent and not affiliated with them.

Availability and changes

We work to keep Moticap available but don’t promise it will be uninterrupted or error-free. Features may change, be added or be removed. Media and exports on our servers are deleted after short periods (see the Privacy Policy), so keep your own copies.

Disclaimer

Moticap is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or content. Our total liability for any claim about Moticap is limited to the amount you paid us for Moticap in the 12 months before the claim, or 100 Saudi riyals if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.

Ending

You can stop using Moticap and delete your account at any time from the app. We may suspend or end your access if you break these terms or if we must by law, and we may stop offering Moticap with reasonable notice. The parts of these terms that by their nature should survive (your content, disclaimers, liability, governing law) continue after the end.

Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes are settled by its competent courts, except where the law of your country gives you consumer rights that cannot be waived.

Changes to these terms

We may update these terms. We will change the date above and, for important changes, tell you in the app or by email before they apply. Using Moticap after that means you accept the new terms.
